Repatriation & Mixed Status Families

Mixed Status Families Definition

A Mixed Status Family is a family where one or more parents has Bermudian Status or holds a Permanent Resident’s Certificate but their son, daughter, or spouse does not have either Bermudian Status or hold a Permanent Resident’s Certificate.

Introduction

The Bermuda Immigration and Protection Amendment Act 2020 received Royal Assent on 19 March 2020 and came into operation on 1 September 2020.  This legislation has been commonly referred to as the “Repatriation & Mixed Status Families” Bill.

One Year Residential Certificate

Bermuda welcomes persons who satisfy the requirements set out below to reside in Bermuda pursuant to section 32 of the Bermuda Immigration and Protection Act 1956 (“BIPA”). Applicants who meet the eligibility requirements will be granted a One Year Residential Certificate (the “1Yr Certificate”). The 1Yr Certificate entitles the person to reside in Bermuda and to work remotely. However the holder is prohibited from seeking or obtaining gainful employment in Bermuda within the tenure of his/her 1Yr Certificate. Each application will be considered on its own merits.

Today’s press conference is to address the outstanding matter of an immigration appeal that has generated significant interest in the community

In late October, I received an appeal from the AME Church asking me in my capacity as Minister of Immigration to overturn a decision to not renew the work permit for Reverend Nicholas Genevieve-Tweed, or Rev. Tweed as he is known locally.

Statement from Ministry of Home Affairs

“The Department of Immigration (DOI), in the normal course of its operations, conducts many investigations, one of which was raised as a matter of concern by M.P. Shawn Crockwell in the House of Assembly on July 1st. The Ministry of Home Affairs can confirm that in this instance, over the course of several weeks, the DOI received multiple complaints from an anonymous complainant about a person who was allegedly working illegally, without a work permit.

Partner-Genuine and Subsisting Relationships

Department of Immigration Instructions in Respect of a “Partner”

(Pursuant to the Work Permit Policies (Section 5.0) as at 1st March 2015)

In assessing whether someone is a “partner” of a work permit holder pursuant to “Sponsored Dependants” under Section 5.0 of Work Permit Policies made effective 1st March 2015, the following guidelines are to be considered prior to issuance of an entry/re-entry permit to the “partner”. The entry/re-entry permit allows the holder to seek employment unless otherwise stated on the entry/re-entry permit.
