PUBLIC NOTICE TO TRADE UNIONS AND THEIR MEMBERS

The Registry General Department would like to take this opportunity to remind all Trade Unions and their Members that pursuant to Section 18 of the Trade Union Act 1965 (TUA), all Trade Unions in operation must file their annual returns by 1st June annually.

Section 18(1)

A general audited statement of the receipts, funds, effects  and expenditure of every trade union registered under this Act shall be submitted to the Registrar before the first day of June in every year, and shall show fully the assets and liabilities at the date, and the receipts and expenditure during the year preceding the date to which it is made out, of the trade union; and shall show separately the expenditure in respect of the several purposes of the trade union, and shall be prepared and made out up to such date in such form, And comprising such particulars, as the Registrar may from time to time require; and any member of and depositor in such trade union shall be entitled to receive, on application to the treasurer or secretary of that trade union, a copy of such general statement without making any payment therefor. Such general statement shall be audited by some fit and proper person or persons appointed or approved by the Registrar.

 

Trade Unions and their officers that fail to comply with the annual reporting requirements contravene Section 18(1) and may be subject to Section 13(1) which states:

Section 13 (1)

The Registrar may withdraw or cancel the certificate of registration of a trade union in the following cases—

(a) at the request of the trade union, to be evidenced in such manner as the Registrar may from time to time direct;

(b) on proof to the satisfaction of the Registrar that a certificate of registration has been obtained by fraud or mistake, or that the principal purposes of the trade union or any of them are not or are no longer statutory purposes, or that any one of the purposes of the trade union is unlawful, or that the trade union has wilfully and after notice from the Registrar violated any of the provisions of this Act, or has ceased to exist; 

 

Those Trade Unions that are not currently in compliance with the provisions of this Act are advised to contact the Registry General Department no later than May 3, 2019 to provide the Department with all their outstanding annual returns or an update on the status of their returns, to avoid possible withdrawal of their registration certificate.

 

The Registry General Department would also like to remind the public that the information pertaining to all registered Trade Unions are a matter of public record and anyone wishing to view the same, may do so at the Registry General Department for a prescribed fee.
