SUMMARY OFFENCES (CURFEW) (No 2) ORDER 2020

 

Whereas the Governor is satisfied that it is in the interests of public safety that the public should be kept off the highways at certain times, the Governor, in exercise of the power conferred by section 14(2) of the Summary Offences Act 1926 makes the following Order:

Citation

1   This Order may be cited as the Summary Offences (Curfew) (No 2) Order 2020.

No person permitted on highways during curfew hours

2    (1) Subject to paragraph 3, no person shall be permitted on any highway during the curfew hours.

      (2) In paragraph (1)—

            “curfew hours” means 8pm to 6am;

            “highway” includes every public road, street, lane, alley, wharf and other public place in Bermuda.

Exemptions

3   A person who has the written permission of a police officer of the rank of Chief Inspector or above is exempt from this Order.

Offence

4   Failure to comply with this Order is an arrestable offence under the Summary Offences Act 1926, and a person is liable on summary conviction to a fine of $2,880 or a term of imprisonment of six months, or both (see sections 24 and 25 of the Act).

Commencement and expiration

5   This Order shall come into effect at 8pm on 1 April 2020 for a period of three days.
