Direction under Article 68 of the Air Navigation
(Overseas Territories) Order 2013

1          Introduction

1.1     This Direction is made in the public interest following the accident of an Ethiopian Airlines Boeing Model 737-8 (737 MAX) aircraft on 10 March 2019. It appears that there are similarities between this accident and Lion Air flight 610 on 29 October 2018 involving the same type of aircraft. At this stage the cause of the accident is not known as investigation into its cause is in progress.

1.2     Given the similarity of the two accidents, the Bermuda Civil Aviation Authority has decided as a precautionary measure in the public interest that operations by Boeing 737-8 MAX and Boeing 737-9 MAX aircraft in the airspace of Bermuda should not take place until appropriate safeguards are in place.

2          Direction

2.1     The Bermuda Civil Aviation Authority in exercise of the Governor’s powers under article 68 of the Air Navigation (Overseas Territories) Order 2013, directs pilots and operators of any Boeing 737-8 MAX and Boeing 737-9 MAX not to conduct any flights after 1900 hours UTC on 12 March 2019 in the airspace of Bermuda.

2.2     This Direction remains in force until suspended, varied or revoked.
