Government Notice
The Minister responsible for air transport in exercise of the powers conferred by Section 8(3)(c) of the Civil Aviation (Air Transport Licensing) Act 2007 (“the Act”) makes the following Order –
1. Section 8(1) of the Act requiring an air transport licence to be held by the operator granted in pursuance of section 9 of the Act shall not apply to the following series of flights, subject to the conditions stated in paragraph 2 below
- scheduled services (as defined in paragraph 3 below) for the carriage of passengers with or without their baggage, cargo and mail operated by Bermudair Limited (Bermudair) between the following points:
a) Bermuda (BDA) and Westchester (HPN),
Westchester (HPN and Bermuda (BDA)
b) Bermuda (BDA) and Boston (BOS)
Boston (BOS) and Bermuda (BDA)
c) Bermuda (BDA) and Fort Lauderdale-Hollywood International (FLL)
Fort Lauderdale-Hollywood International (FLL) and Bermuda (BDA)
d) Bermuda (BDA) and Baltimore (BWI)
Baltimore (BWI) and Bermuda (BDA)
e) Bermuda (BDA) and Orlando (MCO)
Orlando (MCO), Bermuda (BDA)
f) Bermuda (BDA) and Toronto (YYZ)
Toronto (YYZ) and Bermuda (BDA)
g) Bermuda (BDA) and Montreal (YUL)
Montreal (YUL) and Bermuda (BDA)
h) Bermuda (BDA) and Hamilton (YHM)
Hamilton (YHM) and Bermuda (BDA)
i) Bermuda (BDA) and Norfolk (ORF)
Norfolk (ORF) and Bermuda (BDA)
j) Bermuda (BDA) and Halifax (YHZ)
Halifax (YHZ) and Bermuda (BDA)
2. The conditions referred to in paragraph 1 above are:
a. unless consent shall have been given pursuant to sub-paragraphs b. or c. below all aircraft used pursuant to this Order shall be registered in Bermuda in the name of Bermudair (Aircraft)
b. no other aircraft may be used in addition to or in substitution for the Aircraft without the prior written consent of the Bermuda Civil Aviation Authority
c. no operator other than BermudAir shall have authority to operate any flight pursuant to this Order without the prior written consent of the Bermuda Civil Aviation Authority
d. nothing in this this Order shall affect the requirement for the operator to hold an appropriate air operator certificate
3. For the purposes of this Order “scheduled service” means a series of flights
a. in respect of which on each flight all seats and/or capacity to transport cargo and/or mail are available for purchase only by the public (either directly from BermudAir or from its authorised agents), and
b. operated in accordance with a published timetable.
4. This Order shall come into effect when this Notice is published in the Official Gazette and remain valid until 31st October 2024 or until such earlier date as the Minister determines.
