Applying for an Exempted Company License

Section 129A applications

Search help and information

An exempted company that wishes to carry on business in Bermuda beyond the permitted exceptions needs a licence under section 129A of the Companies Act 1981.

Before you apply: the advertisement

Not less than seven days before applying, advertise your intention in an appointed newspaper.

How to apply

Application is made to the Minister under section 129A. The Minister may grant or refuse, and need not give reasons where a grant would not be in the public interest.

What a license cannot authorise

No retail trade
A licence under section 129A may not authorise an exempted company to carry on retail trade with any other person. That limit is in the section itself and cannot be lifted by a condition.

Public inspection of licences

The Minister lodges a copy of every licence granted under sections 114B and 129A with us, and those copies form part of what a search of the register returns.
