Discussion: The technical officer presented the application details to the Board.  A Board Member asked about the specifics of the objection.   The technical officer confirmed all of the points of objection were listed in the Board Report.  A Board Member asked whether the height of the material pile visible in the picture for 1 Waller's Point Road is the maximum height (14'-10”).  The technical officer confirmed she does not know, but based on height of fence and angle, is likely an approximation.

 

The Board resolved to support the technical officer's recommendation to approve the application.

The Board RESOLVED:

To approve the application, as received  3 June, 2019 and revised 3 July 2019 subject to the following condition(s):

1.

The development hereby permitted shall begin before the expiration of 2 (two) years from the date of this permission.

2.

For the avoidance of doubt the consent hereby granted is for planning permission only. Prior to the commencement of building operations a separate application for a building permit that is in compliance with the applicable Building Code must be made and approved.

3.

For the avoidance of doubt, planning permission is hereby granted specifically for the scope and extent of use described in the application submission. Any alternative use or change in operational circumstances shall require express prior permission from the Development Applications Board.

 

4.

In order to safeguard the amenity of the neighborhood, the hours of operation of the hereby approved development shall be restricted to Monday to Saturday from 7 am till 5 pm.

5.

For the avoidance of doubt, stockpiled material should be profile compacted to a maximum height of 14.8 feet.

Advice Note:

The use of any temporary construction equipment such as cranes, derricks, etc should be lowered during times of non-activity where possible.

 

Any use of flood light for nighttime operations should be cleared by Skyport personnel beforehand.

Discussion: The technical officer presented the application details to the Board. The Board queried whether neighbour acknowledgements had been provided.  The technical officer confirmed that acknowledgements had been provided from both affected neighbours.

 

The Board sought confirmation that four parking spaces would be provided.  The technical officer confirmed that four spaces are proposed.

 

The Board resolved to support the technical officer's recommendation to approve the application.

The Board RESOLVED:

To approve the application, as received 20 March, 2019 and revised 27 May 2019, 13 June 2019, 24 June 2019, 1 July 2019 subject to the following condition(s):

1.

The development hereby permitted shall begin before the expiration of 2 (two) years from the date of this permission.

2.

For the avoidance of doubt the consent hereby granted is for planning permission only. Prior to the commencement of building operations a separate application for a building permit that is in compliance with the applicable Building Code must be made and approved.

3.

In the interests of visual amenity, the entire site subject of this application shall be landscaped in accordance with the hereby approved plans prior to the issuance of a Certificate of Completion and Occupancy. Any trees or shrubs shown on approved plans which are removed, which die or which become seriously diseased or damaged shall be replaced by trees and/or shrubs of similar pot size, growth size  and species to those originally required to be planted.

4.

The private outdoor living space shown on the hereby approved plans shall be established for use in accordance with Policies DSN.16 and DSN.17, Chapter 9, of the Draft Bermuda Plan 2018 Planning Statement, prior to the issuance of a Certificate of Completion and Occupancy.

5.

Parking and maneuvering spaces for 4 cars and 4 cycles shall be established for use in accordance with Policies TPT.20 and TPT.27, Chapter 12 of the Draft Bermuda Plan 2018 Planning Statement, prior to the issuance of a Certificate of Completion and Occupancy. 

 

ANY OTHER BUSINESS

Minister of Home Affairs, The Hon. Walter H. Roban, JP MP, to arrive at the conclusion of the meeting to share with the Board members the proposed initiatives the Department is considering to "Streamline the Planning Process".

 

At the conclusion of the meeting, the Minister of Home Affairs, The Hon. Walter H. Roban, JP MP, arrived to discuss with Development Application Board (DAB) members, the Department of Planning's intentions to streamline the planning process along with the overall Government's plan to improve the public “image” of the Department. The Minister indicated that it was important for the Department to continue in providing guidance to the public to enable their goals to be realized when it comes to development projects, whilst at the same time protecting the environment. The Minister further stated that in order to improve the Department's reputation, it was important for re-branding to take place and in doing so, make the planning process less bureaucratic to improve efficiency.  The Minister stressed that the public should not feel the need to involve an agent for every type of application. To conclude, the Minister reiterated the need for the Department to operate in a manner that is more conducive to supporting the growth of the country.

 

Mr. Larry Williams, Assistant Director, advised that one of the initiatives would be to hold “planning clinics” whereby landowners can seek advice from technical officers. Further initiatives will shortly be presented to the DAB by Victoria Pereira, the Acting Director.

Deferred at DAC on Friday, 28 June 2019 for full Board discussion.

 

The technical officer presented the application advising the recommendation was deemed appropriate based on the information provided being the small scope of the project, an addition to an existing accessory structure.  The Board Member who asked for the applications to be deferred explained it is inconsistent and additional information must be provided in accordance with the DAP1 vetting checklist.  The Board resolved to defer the application pending receipt of two building sections and the relevant elevations.
